1. Overview
Trucking Parts (“Trucking Parts,” “we,” “us,” or “our”) operates an online marketplace at truckingparts.com (the “Platform”) that connects buyers with third-party sellers of heavy-duty truck parts and accessories. By accessing or using the Platform, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use the Platform. By creating an account, you represent that you meet these requirements.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information during registration and to update it as needed. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Marketplace Role
Trucking Parts is a marketplace platform, not a retailer. We do not manufacture, stock, or ship the products listed on the Platform. Each transaction is a direct contract between you and the third-party seller. While we vet sellers and monitor listings, we do not guarantee product quality, availability, or seller performance.
5. Orders and Payments
All prices are listed in U.S. dollars unless otherwise noted. By placing an order, you make an offer to purchase at the listed price plus applicable taxes and shipping charges. We process payments through PCI-compliant third-party providers (Stripe). Orders are subject to seller acceptance and may be cancelled if the item is unavailable or if we detect pricing errors or fraudulent activity.
6. Shipping and Delivery
Shipping times and costs vary by seller and destination and are displayed at checkout. Risk of loss passes to you upon delivery to the carrier. We are not liable for delays caused by carriers, customs, or events outside our control.
7. Returns and Refunds
Each seller sets their own return policy, which is displayed on the product page. If a seller does not have a published return policy, the default return window is 30 days from delivery for items in unused, resalable condition. Refunds are processed to the original payment method within 5–10 business days after the seller receives and inspects the returned item.
8. Seller Obligations
Sellers are responsible for listing accurate product information, fulfilling orders promptly, honoring their published return policy, and complying with all applicable laws. We may remove listings or suspend sellers that fail to meet these standards.
9. Prohibited Conduct
You agree not to misuse the Platform. Prohibited activities include, but are not limited to: violating any applicable law; infringing intellectual property rights; submitting false or misleading information; interfering with Platform security; scraping or data mining without permission; and harassing other users or sellers.
10. Intellectual Property
The Platform, including its code, design, text, graphics, and logos, is owned by Trucking Parts Inc. and protected by copyright and trademark laws. Product images and descriptions uploaded by sellers remain the property of those sellers, who grant us a license to display them on the Platform.
11. Limitation of Liability
To the fullest extent permitted by law, Trucking Parts Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any products purchased through it. Our total liability for any claim shall not exceed the greater of the amount you paid us in the twelve months preceding the claim or one hundred U.S. dollars ($100).
12. Disclaimer
The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. Any product warranties are provided solely by the manufacturer or seller, not by Trucking Parts.
13. Indemnification
You agree to indemnify and hold harmless Trucking Parts Inc., its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Los Angeles County, California.
15. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Platform. Continued use after changes take effect constitutes acceptance of the revised Terms.
